OVERVIEW

Welcome to Why Go Less. The terms "we", "us" and "our" refer to Why Go Less SARL. Why Go Less operates a physical store in Dekwaneh, Lebanon and the website whygoless.com, including all related information, content, features, tools, products and services (the "Services"). Why Go Less is powered by Shopify, which enables us to provide the Services to you.

Why Go Less is a curated resale store. We sell brand-new and second-hand items, most of which are held on consignment: the items belong to private suppliers or to partner brands until they are sold, and Why Go Less prepares, prices, lists and sells them. Almost all our stock is single-unit, which shapes several of the terms below.

These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service, our Return and Exchange Policy, our Shipping and Delivery Policy and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or that you are using the Services under the supervision of a parent or legal guardian who accepts these Terms on your behalf. You confirm that you consent to any minor dependent using the Services on devices you own, purchase or manage.

To use the Services, including browsing our online store or purchasing any product, you may be asked to provide certain information, such as your name, email address, phone number, billing address and delivery address. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 - OUR PRODUCTS

Our stock is a mix of brand-new items and second-hand items. Every item is labelled as either BRAND NEW or LIKE-NEW, and every second-hand item is inspected, cleaned and photographed by our team before it is listed. The photographs shown on a product page are photographs of the actual item offered for sale, not stock images, unless a listing states otherwise.

Second-hand items are sold in the condition described in the listing. Signs of prior use consistent with the stated condition and photographs are normal characteristics of second-hand goods and are not defects. Where you are unsure about the condition of an item, contact us before ordering and we will provide additional photographs or detail.

Electronics are tested by our team before listing and again with you at pickup or delivery. Second-hand items are sold without manufacturer warranty unless the listing expressly states that a valid warranty is included.

Colours and product appearance may differ from how they appear on your screen, depending on your device and its settings. We do not warrant that the appearance or quality of any product will meet your subjective expectations beyond the condition and description stated in the listing.

All product descriptions are subject to change at any time at our discretion. We reserve the right to withdraw any item at any time and to limit the quantities we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 - CONSIGNMENT AND OWNERSHIP

Most items sold through the Services are held on consignment. Why Go Less prepares, prices, lists, markets and sells them, handles payment and issues the receipt or invoice. Your contract of sale is with Why Go Less, and Why Go Less is your point of contact for anything relating to your purchase. Title to the item passes to you on full payment.

Large items are listed on whygoless.com only and remain with their owner until sale. Handover of large items is arranged case by case and you may inspect the item at handover, before payment.

Suppliers and partner brands are bound by separate agreements, available as our Supplier Terms and our B2B Terms. Those terms do not create any rights or obligations for you as a customer.

SECTION 4 - ORDERS AND SINGLE-UNIT STOCK

When you place an order, you are making an offer to purchase. Why Go Less reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment or confirm your cash-on-delivery order before it is accepted.

Because our stock is single-unit, availability is not guaranteed by adding an item to your cart. Items are sold on a first paid, first served basis, and an item may sell in store while it is still visible online. If an item you ordered is no longer available, we will contact you and cancel that line of the order, or offer a replacement or store credit where you prefer.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change or cancel an order, we will attempt to notify you using the email address, address or phone number provided at the time the order was placed.

Your purchases are subject to return or exchange solely in accordance with our Return and Exchange Policy. Store credit issued under that policy is valid for 6 months from the date of issue, may be used in store and on whygoless.com, is not exchangeable for cash and is not transferable.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export. Businesses wishing to sell through Why Go Less should contact us about our B2B box and rail program.

SECTION 5 - PRICES, PAYMENT AND BILLING

All prices are quoted in US Dollars (USD). Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation. Unless expressly stated otherwise, posted prices do not include delivery fees or any applicable taxes and charges.

Prices posted online may differ from prices displayed in store where a listing has been updated or a markdown applied. Where a discrepancy arises between the online price and the in-store price for the same item, we will sell at the price recorded in our system and will inform you before confirming the sale.

From time to time we may run promotions governed by their own terms. Where those terms conflict with these Terms, the promotion terms govern for that promotion.

Accepted payment methods are those displayed at checkout, which currently include manual transfer via Whish or OMT and cash on delivery, together with any additional methods we may enable. Where a manual transfer method is selected, your order is held pending confirmation of payment and is released back to stock if payment is not confirmed within the window stated at checkout.

You agree to provide current, complete and accurate purchase, payment and contact information, and to update it promptly so that we can complete your transactions and reach you when needed. Where a card or other electronic method is used, you represent and warrant that you are duly authorised to use it and that all charges incurred by you will be honoured.

SECTION 6 - DELIVERY AND PICKUP

Delivery is available across Lebanon and is arranged by Why Go Less or by a delivery partner acting on our instructions. The delivery fee is paid by the customer and is quoted at checkout by zone.

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by events outside our reasonable control.

For non-electronic items delivered to you, you may inspect the item at the point of delivery and refuse it before payment is made, in which case the order is cancelled and only the delivery fee remains payable. Electronics are tested with you at pickup or delivery. Risk and title pass to you on acceptance and payment of the item.

In-store pickup is free during store hours, Monday to Saturday, 10AM to 7PM, and on Sundays by appointment. Full terms are set out in our Shipping and Delivery Policy.

SECTION 7 - INTELLECTUAL PROPERTY

The Services, including all trademarks, brands, text, displays, images, graphics, product photography, video, audio, and the design, selection and arrangement of them, are owned by Why Go Less, its affiliates or its licensors, and are protected by Lebanese and international copyright, trademark and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material on the Services without our prior written consent. Nothing in these Terms grants you a licence or other rights under any trademark, copyright or other intellectual property of Why Go Less, Shopify or any third party, except as expressly provided. All rights not expressly granted are reserved.

Product photography and product content produced by Why Go Less for a partner brand may be reused by that brand on its own channels under its B2B agreement. No other reuse of our photography or content is permitted.

The Why Go Less name, logo, product and service names, designs and slogans are trademarks of Why Go Less or its licensors and may not be used without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and marks appearing on the Services are the trademarks of their respective owners, and their appearance on an item or a listing does not imply any affiliation with, endorsement by, or authorisation from those owners.

SECTION 8 - OPTIONAL TOOLS

You may be given access to third-party tools through the Services which we neither monitor nor control.

You acknowledge and agree that we provide access to such tools "as is" and "as available", without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third-party tools. Any use of them is entirely at your own risk and discretion, and you should make sure you are familiar with and approve of the terms on which they are provided.

We may in future offer new features through the Services. Such features form part of the Services and are subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you leave the Services to access them, you do so at your own risk.

We are not liable for any harm or damage related to your access to third-party websites, or your purchase or use of any products, services, resources or content on them. Please review the third party's policies and practices before you engage in any transaction. Complaints, claims or questions about third-party products and services should be directed to that third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Why Go Less is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Why Go Less. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Why Go Less, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Why Go Less.

SECTION 11 - PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read both.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and with third parties that may be located in countries other than where you reside, in order to provide services to you. Our Privacy Policy sets out in detail what we collect, why, how long we keep it and who we share it with, including the in-store camera recordings maintained for security.

SECTION 12 - REVIEWS AND FEEDBACK

If you submit, upload, post, email or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use, for example to operate, evaluate, improve and promote the Services.

You represent and warrant that you own or have all necessary rights to the Feedback, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not obliged to, monitor, edit or remove Feedback that we determine to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes any party's rights or these Terms.

You agree that your Feedback will not violate any right of any third party, will not be unlawful, abusive or obscene, and will not contain any virus or other malware. You may not use a false email address, impersonate any person, or otherwise mislead us or others as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy, and we assume no liability for Feedback posted by you or any third party.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally information in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders where any information is inaccurate, at any time and without prior notice, including after you have submitted your order. Where an order is cancelled for this reason after payment, the amount paid for the affected item is credited or returned to you by the method used for payment.

SECTION 14 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, defame, disparage, intimidate or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, receive, upload, download or re-use any material that does not comply with these Terms; (g) to transmit or procure the sending of any advertising or promotional material, including junk mail, chain letters or spam; (h) to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that may harm Why Go Less, Shopify or users of the Services, or expose them to liability.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data gathering or extraction tool, automated process or AI tool, including agentic AI, to access the Services; or (f) interfere with, bypass or circumvent security or authorisation features, robot exclusion headers, or other measures we use to restrict access.

We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 15 - AGENTS

15.1 This section (the "Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any of the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on behalf of a person or using a person's device without direct supervision.

15.2 No Agent may access, use or interact with the Services unless it identifies itself at all times and operates in strict accordance with section 15.4. No Agent may access, use or interact with the Services where we have requested that it refrain from doing so.

15.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.

15.4 Agents must: (i) identify in all HTTP and HTTPS requests that the request is from an Agent, and disclose the Agent's name in the user agent string in the form "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use or interaction is from an Agent, including by mimicking human behaviour and interaction patterns or by completing or circumventing CAPTCHAs or similar measures; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent or avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.

SECTION 16 - TERMINATION

We may terminate this agreement or your access to the Services, or any part of them, at our discretion at any time and without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections continue to apply after any termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Jurisdiction, Privacy, and any other provisions that by their nature should survive.

SECTION 17 - DISCLAIMER OF WARRANTIES

Information presented on or through the Services is made available for general information purposes. We do not warrant its accuracy, completeness or usefulness. Any reliance you place on it is at your own risk, and we disclaim all liability arising from such reliance by you or any other visitor.

EXCEPT AS EXPRESSLY STATED BY WHY GO LESS, AND EXCEPT FOR THE CONDITION AND DESCRIPTION OF EACH ITEM AS SET OUT IN ITS LISTING, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. NOTHING IN THIS SECTION LIMITS ANY RIGHT YOU HAVE UNDER APPLICABLE LEBANESE CONSUMER PROTECTION LAW THAT CANNOT BE WAIVED BY AGREEMENT.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL WHY GO LESS, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PROCURED THROUGH THEM, EVEN IF ADVISED OF THEIR POSSIBILITY. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY IN CONNECTION WITH ANY ITEM IS LIMITED TO THE AMOUNT YOU PAID FOR THAT ITEM. NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Why Go Less, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defence and settlement of such a claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld. You will cooperate in the defence of indemnified claims, including by providing relevant documents.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms. Such a determination does not affect the validity and enforceability of the remaining provisions.

SECTION 21 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with any policies or operating rules posted by us on this site or in respect of the Services, constitute the entire agreement between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, including any prior versions of these Terms.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 22 - ASSIGNMENT

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt is null and void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice to you.

SECTION 23 - LANGUAGE

These Terms are published in English and Arabic. Both versions are provided for your convenience. In the event of any discrepancy between the two versions, the [English / Arabic] version prevails.

SECTION 24 - GOVERNING LAW AND JURISDICTION

These Terms and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of the Lebanese Republic. Any dispute arising out of or in connection with them shall be submitted to the exclusive jurisdiction of the competent courts of Beirut, Lebanon. You and Why Go Less consent to venue and personal jurisdiction in those courts.

SECTION 25 - HEADINGS

The headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 26 - CHANGES TO THESE TERMS

You can review the most current version of these Terms at any time on this page.

We reserve the right, at our discretion, to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. We will notify you of any material changes in accordance with applicable law, and such changes take effect on the date specified in the notice. Your continued use of or access to the Services following the posting of any change constitutes acceptance of that change.
